End-User Licence Agreement

This End-User Licence Agreement ("EULA") governs your licence to use the FWRD platform software and the website it generates for you (together, the "Software"). It is between you and FWRD Digital ("FWRD"). This EULA sits alongside our Terms of Service (which govern conduct and acceptable use) and our Privacy Policy; where this EULA and the Terms of Service overlap, they are read together, and the Terms of Service govern acceptable use.

1. Licence grant

  1. Subject to your compliance with this EULA and the Terms of Service, FWRD grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Software to create, edit, publish and operate one or more websites for your own business or personal purposes.
  2. The licence lasts for as long as your account or use of the Platform continues, and ends automatically if this EULA or the Terms of Service are terminated.

2. Ownership

  1. FWRD and its licensors own all rights in the Platform, its underlying software, templates, design system, generic components, and the AI orchestration around it. Except for the licences expressly granted here, no rights are transferred to you.
  2. You own the content you provide ("Your Content"). As between you and FWRD, and once any applicable fees are paid, you receive the right to use, host and publish the specific website generated for you for your own purposes. Excluded from any transfer are: (a) FWRD's generic, reusable components, scripts, design-system parts and boilerplate developed before or outside your use of the Platform; and (b) third-party software (frameworks, libraries, fonts) subject to their own licences.

3. Restrictions

You must not, and must not allow anyone else to:

  1. copy, modify, reverse-engineer, decompile or attempt to derive the source code or underlying models of the Software, except to the extent this restriction is prohibited by mandatory law;
  2. resell, rent, sublicense, or provide the Software as a service to third parties, except as expressly permitted;
  3. use the Software, its AI features, or its output to build, train or improve a competing product or model, or to systematically extract or scrape its output;
  4. circumvent or abuse usage limits, rate limits, security controls, or the intended way the AI features are accessed;
  5. remove or obscure proprietary notices, or use FWRD's name or marks except as permitted.

4. AI-generated output

  1. The Platform's AI features generate and edit content based on the input you provide. These features are powered by a third-party large language model (currently DeepSeek), and the content you submit is processed to produce your result as described in the Privacy Policy. FWRD may change the model or provider over time to keep the service working well.
  2. AI output is provided "as-is". It can be inaccurate, incomplete, or unintentionally similar to existing material, and identical or similar output may be generated for other users. You are responsible for reviewing AI output and for ensuring the content you publish is accurate, lawful, and does not infringe others' rights.
  3. To the extent FWRD holds any rights in the output the Platform generates specifically for you, FWRD assigns or licenses those rights to you (as applicable under §2) so you can use that output for your website. This does not give you rights in the model, the Platform, or FWRD's reusable components.

5. Third-party components

The Software includes third-party frameworks, libraries and fonts that remain subject to their own licences. Nothing in this EULA overrides those licences. Your use of any third-party service you connect (for example analytics) is subject to that service's terms.

6. Feedback

If you give FWRD feedback or suggestions about the Software, FWRD may use them without restriction or obligation to you.

7. Term and termination

  1. This EULA applies for as long as you use the Software. FWRD may suspend or terminate the licence if you materially breach this EULA or the Terms of Service, in line with §6 of the Terms of Service.
  2. On termination, your licence to use the Software ends. Content you have already published to your own hosting, or exported, is not affected by the end of the licence to the Platform itself, subject to any third-party licences in §5.

8. Disclaimer and liability

The Software is provided without warranties of any kind, to the maximum extent permitted by law. FWRD's liability in connection with the Software is limited as set out in §10 of the Terms of Service. Nothing here excludes liability that cannot be excluded under mandatory law.

9. Governing law

This EULA is governed by Dutch law, and disputes are handled as set out in §12 of the Terms of Service.
